By accessing or using the GetPhantom website (https://getphantom.online) and our Done-For-You (DFY) AI implementation services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
GetPhantom is an implementation service and software operating system that automates client messaging, bookings, follow-ups, and studio operations for tattoo studios using artificial intelligence ("Phantom Engine"). The Service includes:
3.1 Free Audit: GetPhantom offers a complimentary studio audit to assess fit. The audit does not constitute a binding agreement.
3.2 DFY Setup: Upon agreement, GetPhantom will configure and deploy the Phantom Engine for your studio. Setup typically includes a 7-day shadow mode (AI drafts, you approve) followed by full automation.
3.3 Access Requirements: You agree to provide GetPhantom necessary access to your studio's communication platforms (e.g., social media inbox, CRM pipeline, booking calendar) solely for the purpose of configuring and operating the Service.
4.1 Accurate Information: You agree to provide accurate studio information including artist roster, pricing, policies, and operating hours.
4.2 Client Consent: As the studio owner, you represent and warrant that you possess the necessary rights and consents from your clients for GetPhantom to process their communications on your behalf.
4.3 Human Override: You retain full control to override AI responses at any time. When you manually reply to a conversation, the system pauses automated responses for that contact for 48 hours.
5.1 Pricing: Service pricing is determined during the audit based on studio size, volume, and selected modules. Specific pricing is communicated prior to engagement.
5.2 Billing Cycle: Services are billed monthly in advance. Late payments beyond 7 days may result in temporary service suspension.
5.3 Performance Guarantee: If the Phantom Engine does not generate sufficient value to cover its monthly cost within the first 30 days, that month is on us. This guarantee applies once per client.
6.1 AI Reliability: While the Phantom Engine is rigorously configured and monitored, AI can occasionally generate unexpected responses. GetPhantom is not liable for lost revenue, booking errors, miscommunications, or damages resulting from automated interactions.
6.2 "As Is" Basis: The Service is provided "as is" and "as available," without warranty of any kind, express or implied.
6.3 Limited Liability: In no event shall GetPhantom's total liability exceed the total amount paid by you for the Service in the 3 months preceding the claim.
6.4 Uptime: We strive for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.
The core Phantom Engine technology, workflow logic, training methodologies, website design, and trademarks remain the exclusive property of GetPhantom. You retain all rights to your own studio data, branding, and client relationships.
Both parties agree to maintain confidentiality of proprietary information exchanged during the service relationship. This includes but is not limited to: pricing structures, business metrics, client data, and technical configurations.
9.1 By Client: You may cancel the Service with 14 days written notice. Service will continue until the end of the current billing period.
9.2 By GetPhantom: We reserve the right to terminate or suspend access immediately, without prior notice, for breach of these Terms, failure to pay, or misuse of the platform.
9.3 Post-Termination: Upon termination, we will deactivate the Phantom Engine for your studio. Your studio data can be exported upon request within 30 days of termination.
You agree to indemnify and hold harmless GetPhantom and its team from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.
We may update these Terms from time to time. Active clients will be notified of material changes via email at least 14 days in advance. Continued use of the Service after changes constitutes acceptance.
